LANDLORD-TENANT APPEALS


How To Appeal Evictions:

  • Tenant has ten days from date of District Judge’s decision to appeal judgment if they wish to stay on property. 

    • If requesting an appeal more than 10 days from Magisterial District Judge's eviction decision:  

    • Individuals can check the Bucks County Law Library for information about filing a Petition for nunc pro tunc 

  • Access appeal form by visiting Notice Of Appeal From Magisterial District Judge Judgement
  • Supreme Court Cover Sheet Cover Sheet Cover Sheet For Common Pleas Civil Filings
  • The judgment must be from a Bucks County District Judge. 
  • Tenant must include copy of District Judge’s decision (notice of judgment transcript) along with the participants list 
  • Filing Fee: $ 263.00

Rent to be posted:  

  • The lesser amount of either three months’ rent or current arrears as stated on judgment.  This also must be             paid with cash, check or money order time of filing appeal. 
  •  Rent is due to Prothonotary Office every 30 days from date of filing appeal. 
  • If filing Section 8 - Tenant will pay 1/3 of current month’s rent at time of filing appeal and 2/3 of current month’s rent 20 days later.

Financial Assistance:

An In Forma Pauperis (IFP) is available for individuals that may qualify  IFP Form
